1. INTRODUCTION

These General Terms and Conditions („Terms„) govern the legal relationship between Külföldi Employees („Service Provider„, „we„, or „us„) and the individual applicant („Candidate„, „you„) who utilizes the services provided through our website (www.foreignemployeerescue.com). By registering on the website and transferring the fees defined below, you expressly accept these Terms.

2. SCOPE OF SERVICES

The Service Provider acts as an intermediary. Our primary role is the registration of the Candidate into our database, the processing of their professional profile, and the forwarding of said profile to third-party recruitment partner agencies („Recruitment Agency„) for evaluation purposes.

3. APPLICATION PROCEDURE AND FINANCIAL TERMS

The application process involves two types of payments, which have different legal classifications: a service fee and a deposit (caution money).

Phase 1: Registration (service fee)

  • Amount: 25 EUR ( 20 EUR + 5 EUR VAT)
  • Method of Payment: This is a Registration Fee. It is a service fee for administrative tasks, including data processing, translation (where applicable), and the inclusion of the Candidate in the Service Provider’s registry.
  • Invoicing: The Service Provider shall issue a VAT Invoice for this amount upon receipt of payment.
  • Refundability: This fee is non-refundable, as it covers administrative work already performed.

Phase 2: Active job search (Deposit)

  • Condition: This phase is only applicable if the Recruitment Agency accepts the Candidate into its recruitment system.
  • Amount: 200 EUR (VAT exempt).
  • Nature of Payment: This is a Deposit (financial guarantee). It is NOT a service fee, but a security measure to ensure the Candidate’s commitment and compliance with the agreement.
  • Documentation: Initially, the Service Provider does NOT issue an invoice for the deposit. Instead, a Payment Receipt (Acknowledgment of Receipt) is issued to certify that the amount has been placed in escrow.
  • Purpose: The deposit serves as a commitment bond. It is intended to be returned to the Candidate at the end of the process, regardless of whether a job was successfully found, provided the rules are followed.

4. PAYMENT INSTRUCTIONS

Payments must be fulfilled via bank transfer. The Candidate is responsible for any transfer fees charged by their own bank.

  • Reference: Please use the Candidate’s Full Name as the reference.

5. REFUND POLICY AND BREACH OF AGREEMENT

The Deposit (200 EUR) is held in trust during the active job search period. Our goal is to refund this amount to every Candidate who completes the process in good faith.

5.1. Refund of the deposit

The Deposit will be refunded in full to the Candidate in both successful and unsuccessful cases, specifically if:

  • The Recruitment Agency successfully presents a suitable job offer within the agreed period and the Candidate accepts it.
  • The Recruitment Agency fails to present a suitable job offer within the agreed period.
  • The Candidate has complied with all terms of this Agreement and has remained cooperative throughout the search period.

5.2. Forfeiture of the deposit (breach of agreement)

The Deposit will only be retained by the Service Provider as compensation for damages if the Candidate violates this Agreement. In such cases, the retained amount is not subject to VAT.

Breach of agreement includes:

  1. Independent Employment: The Candidate finds a job independently during the active search period without completing the agreed term.
  2. Unreasonable Refusal: The Candidate unreasonably refuses suitable job offers.
  3. Non-Communication: The Candidate stops communicating during the process.
  4. Unannounced Departure: The Candidate leaves their current residence without prior notice.

6. DATA PROCESSING

By submitting the application, the Candidate consents to their personal data being processed and forwarded to third-party Recruitment Agencies for the purpose of job matching.

7. LIMITATION OF LIABILITY

The Service Provider is not the employer and is not liable for the terms of the employment contract, nor for decisions made by the Recruitment Agency.

DUE TO NEW HUNGARIAN LAW, AFTER THE TRANSFER OF EMPLOYMENT, THE NEW REGISTRATION FOR THE NEW COMPANY IS AUTHORIZED FOR 1 YEAR ONLY!

If the new employer is satisfied with the Candidate’s performance, there is a possibility that the company will re-employ them. In such cases, a new visa application can be submitted from the Philippines, which may grant a residence permit for a period of 2+1 years for the first time.
